See below our take on topics that are affecting your industry this month: IR35 in the Public Sector  For all payments after 6 April 2017, regardless of whether a contract was commenced before this date new rules apply to Public Sector workers. Affected workers providing services through an intermediary to a public authority are no longer responsible for determining their own IR35 status, instead of the contractors judging their own IR35 status, that responsibility will fall on the public sector engager. This can be either the public body end user or a recruitment agency. The rules will probably apply where:   The worker is required to work at the end client’s site  The worker is supplied with equipment by the end client  The worker is directed by a manager or other officer of the public sector body  The worker is leading a team  To be outside IR35, the worker should:   Work mainly from their own office  Provide their own equipment  Employ their own staff   Meet their own costs/ expenses Several Legal Expenses providers restrict cover relating to Tax issues arising from IR35.
