3) Third Offense OUI (Felony)

- Incarceration in place of amendment for 180 days—150 days compulsory—and up to five years in state jail;- $1,000-$15,000 fine

- Loss of License for a long time (work/training hardship considered following 2 years, general hardship considered following 4 years)

4) Fourth Offense OUI (Felony)

- Incarceration for a long time—1 year compulsory—and up to five years;

- $1,500-$25,000 fine

- Loss of License for a long time (work/training hardship considered following 5 years, general hardship considered following 8 years)

5) Fifth Offense OUI (Felony)

- Incarceration for 2 ½ years—2 year compulsory—and up to five years;

- $2,000-$50,000 fine

- Loss of License forever, hardship not accessible
